These Terms of Service (“Terms”) govern your access to and use of the website, online store, content, features, tools, and services provided by DermaLabs Molecule Series LLC – DermaDAO (“DermaLabs,” “we,” “us,” or “our”). Our store is hosted by Shopify. By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

1) Eligibility & Accounts

  • You must be at least 18 years old (or the age of majority in your jurisdiction) to make purchases.

  • You are responsible for the accuracy of information you provide and for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized use of your account.

 

2) Orders, Pre-Orders & Contract Formation

  • All orders (including pre-orders) are offers to purchase. We may accept or reject any order at our sole discretion (e.g., due to availability, suspected fraud, pricing or description errors).

  • Pre-Orders. When you place a pre-order, your payment method may be charged at checkout. Estimated ship dates are provided for convenience and may change due to manufacturing or logistics constraints.

  • Final sale for change of mind. Pre-orders cannot be canceled or refunded due to change of mind or preference. Pre-ordered items are eligible for replacement or refund only if damaged, defective, wrong item shipped, or delivered unsealed (tamper-evident seal broken/missing upon delivery), subject to our Returns & Refunds Policy.

  • We do not sell to resellers. We may limit or cancel quantities per person, household, or order.

 

3) Pricing, Taxes & Payments

  • Prices, promotions, and availability are subject to change without notice.

  • Prices exclude shipping, duties, taxes, and fees, which are shown at checkout or charged separately. You are responsible for all applicable duties and taxes for international deliveries.

  • You authorize us (and our payment processors) to charge your payment method for the total amount of your order, including shipping, taxes, and any adjustments.

  • In case of pricing or description errors, we may contact you for instructions, cancel the order, or refuse service, even after you receive an order confirmation.

 

4) Shipping, Delivery & Risk of Loss

  • We will ship to the address you provide. Delivery dates are estimates and not guaranteed; delays can occur.

  • Risk of loss passes to you upon delivery to the shipping address on record. For returns, you bear the risk of loss until we receive and inspect the item(s) (see Returns & Refunds Policy).

  • International shipments may be held by customs. We are not responsible for customs delays or assessments.

 

5) Returns, Refunds & Exchanges

  • Our Returns & Refunds Policy is incorporated into our Terms of Service.

  • For health and hygiene reasons, opened/used items or items with broken seals cannot be returned or refunded.

  • Pre-orders are final sale for change of mind; eligibility for replacement or refund is limited to cases of damage, defect, wrong item, or delivered unsealed, as set out in our Returns & Refunds Policy.

  • We do not offer direct exchanges.

 

6) Product Information & No Medical Advice

  • Products sold are cosmetic products. Information on the Services is for informational purposes only and is not medical advice. Products do not diagnose, treat, cure, or prevent disease.

  • Individual results vary. Patch test if you have reactive skin or known sensitivities.

 

7) Promotions, Gift Cards & Bundles

  • Promotional codes must be used within their validity period and cannot be combined unless stated.

  • Gift cards and certain promotional items may be final sale.

  • Bundles/kits must be returned complete and unopened to be eligible for a refund (see Returns & Refunds Policy).

 

8) User Content & Reviews

  • If you submit reviews, comments, images, or other materials (“User Content”), you grant DermaLabs a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, sublicensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display such content in connection with the Services and our business.

  • You represent that your User Content is accurate, lawful, and does not infringe any third-party rights, and you will not submit content that is defamatory, obscene, misleading, or otherwise prohibited.

 

9) Intellectual Property

  • The Services and all content, including text, images, graphics, logos, product names (including “DermaLabs,” “DermaDAO,” “Moon Drops,” and “Sun Drops”), and software are owned by or licensed to DermaLabs and protected by intellectual property laws.

  • You are granted a limited, non-exclusive, revocable license to access and use the Services for personal, non-commercial use. You may not copy, modify, distribute, sell, or exploit any part of the Services without our prior written consent.

 

10) Acceptable Use

You agree not to:

  • Violate any applicable law or regulation;

  • Interfere with or disrupt the Services or servers;

  • Access the Services using automated means (bots, scrapers) except as permitted by robots.txt;

  • Attempt to circumvent security or authentication measures;

  • Upload or transmit malware or harmful code;

  • Misrepresent your identity or affiliation;

  • Engage in activity that infringes intellectual property or privacy rights.

 

11) Third-Party Services & Links

  • The Services may integrate or link to third-party websites, apps, or services (including Shopify and carriers). We are not responsible for third-party content, policies, or practices. Your use of third-party services is governed by their terms and privacy policies.

 

12) Privacy

  • Your use of the Services is subject to our Privacy Policy, which explains how we collect, use, and share information. The Privacy Policy is incorporated into these Terms.

 

13) Disclaimers

  • The Services and all products are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

  • We do not warrant that the Services will be uninterrupted, secure, or error-free, or that defects will be corrected.

 

14) Limitation of Liability

To the maximum extent permitted by law, DermaLabs and its officers, directors, employees, agents, affiliates, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, goodwill, or business interruption, arising out of or related to your use of (or inability to use) the Services or products, even if advised of the possibility of such damages. Our total liability for any claim will not exceed the amount you paid to DermaLabs for the product giving rise to the claim.

Consumer rights. Some jurisdictions do not allow certain disclaimers or limitations; in those cases, the above will apply to the maximum extent permitted. Nothing in these Terms limits any non-waivable statutory rights you may have (e.g., under EU/UK consumer law).

 

15) Indemnification

You agree to indemnify, defend, and hold harmless DermaLabs and its officers, directors, employees, agents, affiliates, and suppliers from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your violation of these Terms, your misuse of the Services, or your infringement of any rights of another party.

 

16) Governing Law & Venue

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law rules. Subject to applicable consumer law, you agree to submit to the exclusive jurisdiction and venue of the state and federal courts located in Delaware for any dispute not subject to arbitration/mediation or where such courts must be used. If you are a consumer residing in the EEA/UK, you may bring claims in your country of residence as required by mandatory law.

 

17) Suspension & Termination

We may suspend or terminate your access to the Services at any time, with or without notice, for any breach of these Terms or for any other reason. Upon termination, the licenses granted to you under these Terms will cease.

 

18) Changes to the Services or Terms

We may modify the Services and/or these Terms from time to time. The updated Terms will be posted with a new “Last updated” date. Your continued use of the Services after changes become effective constitutes acceptance of the updated Terms.

 

19) Severability; Waiver; Assignment

If any provision of these Terms is found invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full force. Our failure to enforce any right or provision is not a waiver. You may not assign these Terms without our prior written consent.

 

20) Entire Agreement

These Terms, along with any policies referenced herein (including our Privacy Policy and Returns & Refunds Policy), constitute the entire agreement between you and DermaLabs regarding the Services and supersede all prior agreements and understandings.
